Step 4 — Seek Appropriate Legal Relief

If the obstruction continues despite complaints, you have the right to approach:

• The appropriate authority — depending on your society's rules and applicable local laws.
• The Civil Court — for an injunction restraining the neighbour from obstructing your parking space, and for damages if applicable.
• The Police — in cases where the obstruction is accompanied by threats, intimidation, or a breach of peace.

Your parking space is your legal right. Repeated obstruction is not something you must tolerate. The law provides clear remedies — use them.

• Other important conditions — confidentiality, dispute resolution, termination

Under the Indian Contract Act, 1872 (Section 10 — Free Consent; Section 73 — Breach of Contract), a valid written agreement is enforceable in court. It removes ambiguity and gives both parties clarity on their obligations. No document protects a business more effectively than a well-drafted written agreement.

02 — Purchase Order or Work Order

A Purchase Order (PO) or Work Order serves as clear, contemporaneous proof that the other party instructed, accepted, or ordered the work or supply. It records the specifics of what was ordered, the quantity, the price agreed, and the delivery terms. Under the Bharatiya Sakshya Adhiniyam, 2023 (Section 63), electronic records — including digitally signed POs and Work Orders — are admissible as evidence. This means your emails and digital records have legal weight.

03 — GST Invoice

A GST invoice creates a valid, legally recognised record of the supply of goods or services and the amount payable. Under the CGST Act, 2017 (Section 31 — Tax Invoice mandatory for supply), issuing a proper tax invoice is not just good practice — it is a legal obligation. In any payment dispute, a GST invoice is one of the strongest pieces of documentary evidence you can produce.

• Check Your Documents — Follow your building byelaws, RWA rules, ownership documents and sanctioned building plans before proceeding.

Can a Neighbour Object?

Yes — a neighbour can legally object if the installation:

• Damages their property
• Uses their area without consent
• Affects the structure or common use of the building
• Creates a nuisance or safety risk
• Violates building rules or byelaws

An objection with legal basis is not mere harassment — it is a legitimate exercise of rights. Courts and authorities take such complaints seriously.

Legal Remedies Available

The goal is responsible installation — one that respects shared spaces, complies with safety norms, and maintains peaceful living. Going green is a worthy choice; doing it lawfully makes it the right one.

Even where salary was paid in cash, the following evidence can support your position:

• WhatsApp messages and email communications acknowledging receipt or discussing salary
• Attendance records
• Employee registers and appointment letters
• Salary ledgers and books of account
• Bank statements showing cash withdrawals on salary dates (as a supporting factor)
• Testimony of other staff or witnesses
• CCTV footage if available

What You Should Do Immediately

Best practice going forward: Pay salary through bank transfer wherever possible. If cash payment is unavoidable, obtain the employee's signature or thumb impression on a salary register or wage sheet. Maintain proper salary records, attendance registers and payment acknowledgements. Small records today can prevent major disputes tomorrow.

• Respond in Writing — Never ignore a legal notice or consumer complaint. File a detailed and timely reply with supporting documents and facts. Silence or delay is almost always interpreted against you.
• Do Not Replace Goods Under Pressure — If the product requires inspection by the manufacturer or warranty provider, follow the prescribed process. Do not give in to unjustified demands out of fear of a complaint — it can be treated as an admission.
• Contest False or Exaggerated Claims — Present your documentary evidence, highlight the relevant facts and applicable legal provisions, and contest the complaint confidently before the Consumer Commission.

• ₹2,00,000 — Cash Receipt Limit (Section 269ST) — A person cannot receive ₹2 lakh or more in cash from a single person for a single transaction or transactions relating to one event or occasion. The penalty can be equal to the amount received.

What About Kirana Stores and Daily Cash Transactions?

Daily small cash sales at local stores are perfectly valid and common. Issues arise only when transactions cross the legal limits mentioned above and there is no documentary record. Keep proper records, stay within limits, stay compliant, and stay protected.

No Proof of a Cash Transaction — What Can You Do?

Even if a cash transaction was made without a formal receipt, you can still rely on other evidence:

• Bank Khata or Ledger
• Invoices and Bills
• WhatsApp Messages
• Witnesses — employees or delivery staff
• Delivery Records
• Admission by the Customer
• CCTV Footage
• Any other supporting documents

Legal Remedies When Payment is Not Received

• The seat decides the applicable law — The place or "seat" of arbitration determines which law governs the proceedings. This can have significant implications, especially in commercial contracts.

What You Should Do Before Signing

Do not sign in a hurry. Read. Understand. Then sign. A contract is not merely a formality — it is a legal document that governs your rights and obligations. Treat it accordingly.

Partnership is built on trust. When one partner begins running a competing business on the side — without the knowledge or consent of the other partners — it is not merely a breach of ethics. It is a violation of legal duties clearly established under the Indian Partnership Act, 1932, and it exposes the errant partner to serious legal consequences.

• Breach of the legal duty of loyalty and good faith

• Loss of trust may lead to dissolution of the firm

What Can the Firm Do?

When competition may be allowed: With the consent of all partners; after retirement from the firm; if the partnership agreement expressly allows it; or if the business is not similar to or does not compete with the firm's business.

• Nature of Tenancy — Whether the arrangement is a lease, a licence, or a leave and licence agreement determines your rights and the remedies available.

Important to Know

For Landlords

If you wish to recover possession after the agreement expires, send a written notice to vacate, and if the tenant does not vacate, file an appropriate suit or eviction petition through the legal process. Do not accept rent if you intend to treat the tenancy as expired.

For Tenants

If your agreement has expired and you are in continued possession, your rights depend on the specific facts of your situation. You are not automatically illegal — but your position becomes more precarious over time if rent is not being accepted or a notice has been issued.
